Terms of Service

Please read these Terms of Service ("Terms") carefully before using the Sendo platform. By creating an account, purchasing a service, or uploading documents, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Service.

2. The Service

2.1. Sendo is a Software-as-a-Service (SaaS) platform that uses Artificial Intelligence (AI) to analyse Special Educational Needs (SEN) documentation.

2.2. Nature of AI Analysis

You acknowledge that the Service's "Audits", "Needs Extractions", "Drafting Assistance" and all other outputs are generated algorithmically by large language models (LLMs). AI-generated content is probabilistic and may contain errors, omissions, hallucinations, outdated information, or inaccuracies. While we aim for high quality and reliability, we do not guarantee accuracy.

2.3. Service Availability

We do not guarantee uninterrupted access to the Service. We may suspend, restrict, or withdraw the Service for maintenance, operational, business, or security reasons.

2.4. No Guarantee of Outcomes

We do not guarantee that:

  • Local Authorities, Tribunals, schools or professionals will accept or act upon documents created using the Service;
  • The Service will identify every need, error, or omission in an EHCP or report.

3.1. Sendo is an information and drafting tool. We are not a law firm.

3.2. Nothing generated by the Service constitutes legal advice.

3.3. We do not represent you, act on your behalf, or correspond with Local Authorities, schools, legal representatives, or Tribunals.

3.4. You remain fully responsible for:

  • Reviewing and verifying all AI-generated outputs;
  • Ensuring the factual accuracy of the documents you submit;
  • Deciding whether to rely on, use, or submit any documents produced by the Service.

3.5. We strongly recommend that all critical legal submissions be reviewed by a qualified solicitor, caseworker, or SEN advocate.

3.6. No solicitor–client relationship or legal privilege is created by your use of the Service.

4. User Accounts & Data Obligations

4.1. To access the Service, you must create a secure account. You must keep your login details confidential and notify us immediately of any unauthorised access.

4.2. Authority to Upload Child Data

You represent and warrant that you have a lawful basis under the UK GDPR to upload any personal data, including children's data. This means you must be:

  • The child's parent or legal guardian; or
  • An authorised professional acting with the clear, explicit consent of the parent or legal guardian.

4.3. You must not upload content that is illegal, harmful, offensive, defamatory, or infringes the rights of any individual.

4.4. You are responsible for retaining your own copies of any documents uploaded or generated. Sendo is not a permanent file-storage service.

4.5. We may suspend or remove content, or restrict your account, if we reasonably believe you have breached these Terms.

4.6. You are responsible for ensuring that all information you upload is accurate and lawful.

5. Payments, Refunds & Cancellation

5.1. Our digital services are classified as "digital content" under the Consumer Contracts Regulations 2013.

5.2. Waiver of Cooling-Off Period

By clicking "Pay" and starting an audit or upload, you expressly consent to the digital content being supplied immediately. You acknowledge that you lose your statutory 14-day cancellation right once processing begins.

5.3. Refund Policy

Due to the immediate processing costs, we do not offer refunds for "change of mind" once documents have been processed.

5.4. Consumer Rights Act 2015

Nothing in these Terms affects your statutory rights. If the digital content is defective (e.g., corrupted files or failure of the system to run), you are entitled to a repair or replacement. If this is impossible, you may be entitled to a price reduction.

5.5. Processing of your documents begins automatically upon upload or initiation of an audit.

6. Intellectual Property

6.1. Our Intellectual Property

All intellectual property rights in the software, AI prompts, models, website content, design, and the Sendo brand belong to us or our licensors.

6.2. You agree not to copy, reverse-engineer, scrape, or attempt to derive any source code, prompts, backend logic, or proprietary methods.

6.3. Your Documents

You retain full ownership of documents and data you upload.

6.4. Generated Content

Upon payment, we grant you a perpetual, non-exclusive, worldwide licence to use, reproduce, edit, and submit the specific reports, drafts, and letters generated for your case.

6.5. We do not use your personal documents to train AI models without your explicit consent.

7. Acceptable Use

7.1. You must not use the Service:

  • In breach of any applicable law;
  • To transmit malware or harmful code;
  • To attempt to disrupt, overload, or misuse the Service;
  • To test or evaluate the system for competitive, adversarial, or unauthorised research purposes;
  • To generate fraudulent or misleading documents.

7.2. We may throttle or limit usage that exceeds reasonable levels to protect system performance.

7.3. We may suspend any account that breaches these rules.

8. Limitation of Liability

8.1. AI Accuracy Disclaimer

We accept no liability for loss or damage arising from reliance on AI-generated outputs. You use such outputs entirely at your own risk.

8.2. We are not responsible for decisions or actions taken by Local Authorities, schools, legal bodies, healthcare professionals, or Tribunals.

8.3. Loss of Data

Whilst we use encryption and secure backups, we are not liable for any loss, corruption, or deletion of data.

8.4. Financial Liability Cap

To the fullest extent permitted by law, our total liability to you shall not exceed the amount you paid for the relevant Service.

8.5. Nothing in these Terms limits or excludes liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation;
  • Any other liability that cannot lawfully be excluded.

9. Termination

9.1. We may suspend or terminate your account immediately if you breach these Terms.

9.2. You may close your account at any time via your dashboard settings.

9.3. Upon termination, your access to the Service ceases immediately. We may delete your data in accordance with our Data Retention Policy.

10. Data Protection

10.1. We process personal data in accordance with our Privacy Policy, which forms part of these Terms.

10.2. By using the Service, you consent to such processing and warrant that all data you upload is accurate and lawfully obtained.

10.3. For uploaded child data, you act as the primary data controller, and we act as a data processor for the purposes of UK GDPR.

11. Changes to These Terms

11.1. We may update these Terms periodically.

11.2. We will notify you of material changes (e.g., pricing, features, data handling) via email or a prominent notice on your Dashboard.

11.3. Continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

12. Governing Law

12.1. These Terms are governed by the laws of England and Wales.

12.2. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
